Terms and Conditions

This is a detailed policy statement outlining the terms and charges for services provided by a charter flight company. Here's a summary of key points:

1. This is only a Quotation. The Charter will be confirmed only after receipt of 100% payment in advance.

2. Mentioned flight timings & cost are representations under NIL wind conditions and billing would be on actual block time taken for the flight from “chocks off to chocks on”, depending upon weather/ wind/ fog/ visibility conditions.

3. Standard Catering included in the above quotation (INR 5000 Per Sector). Any Special request will be charged at additional cost above INR 5000.

4. This Quote/ offer is made on a best- effort basis. Any cancellation necessitated due to technical reasons/non-availability of permits or landing slots or reasons beyond the control of Operator will not attract any penalty/ claim from the charterer.

5. Crew layover in case of prolonged halts during the course of single day at particular station, the “charterer” will make suitable arrangements for boarding, lodging & local transport or we will make the necessary arrangements on additional cost.

6. We shall not be liable for any delay/ inconvenience caused towards diversion, due to bad weather/ VIP movements, unforeseen circumstances caused by nature or due to force majeure reasons. In such conditions, charterer has to bear the cost of extra flying/ overnight halt/ waiting etc.

7. Additional sectors required after start of the flight itinerary will be on the sole discretion of Target Air Services Pvt Ltd

8. The flight duty time and flight time will be governed by DGCA – CAR – 7 – J III & IV dated 23.03.2021 effective from 30.09.2022.

9. Minimum booking value for a charter would be 2 Hrs of flying per booking per day. The Flying Hrs. mentioned in the quotation is only indicative since:

• Any diversions due to weather or the air route not being available due decision of Airport Authority / Air Traffic Control or due to defense activity; will be billed at actuals after the flight is conducted in the final INVOICE.
• Day & Night parking at some airports are subject to the availability of Parking Bays at these airports. In case of non-availability of Parking space we may have to move-out the aircraft / re-position the aircraft / go on a local flight to clear the parking bay for schedule flights - under such circumstances [if required] the cost of such re-positioning of aircraft will be billed at actuals after the flight is conducted in the final INVOICE.

10.Payment:
25% of the charter estimated cost shall be payable in advance at the time of blocking the aircraft.
100% of the estimated cost shall be payable in case the flight is confirmed less than 15 days to the actual date of flying.
Payment can be made via cheque/DD/wire transfer in the name of ‘Target Air Services Pvt Ltd.' payable at Delhi.

11. Cancellation:
Cancellation Charges would be levied as a percentage of the total INVOICE value, which would be as follows:-

• 10%- against flight preparation charges will be levied if flight is cancelled due to “force majeure” reasons.
FORCE MAJEURE :- No Party shall be liable or responsible to the other party , nor be deemed to have defaulted under or breached this agreement, for any failure or delay in fulfilling or performing any terms of this agreement when and to the extent such failure or delay is caused by results from acts beyond the impacted party’s; reasonable control , including , without limitation, the following force majeure events (a) act of God, (b) flood, (c) fire, ( d ) earthquake or explosion (e) war , invasion , hostilities, terrorist threat or acts, riots , other civil unrest (f) Government orders or law ( g) actions , embargoes or blockades, in effect on or after the date of this signing this agreement ( h) action by Government authorities , national and regional emergencies , (i) epidemic, pandemic , similar influenza or bacterial infections, (j) radioactive contamination (k) shortage of adequate medical supplies and equipment or any other similar events that are beyond reasonable control of Impacted party.

• 25% of charter cost is non-refundable if cancelled at any moment after blocking the aircraft.
• 50% of the total estimated charter cost will be levied if the flight is cancelled within 72 to 48 hours of the scheduled departure
• 75% of the total estimated charter cost will be levied if the flight is cancelled within 48 to 24 hours of the scheduled departure
• 100% of the total estimated charter cost will be levied if the flight is cancelled within 24 hours to the scheduled departure.

Any cancellations/changes (if the same cannot be executed due to operational reasons / lapse or lack of relevant permissions) in flight sectors after the commencement of the ‘flight program’ will be termed as a as ‘a last minute cancellation’ - and the cancellation clause of 100% would apply.

12. Other Charges:
• Day Detention charges @ INR 50,000/- per hour {for Domestic} and US$ 350 per hour {for International airports} will be charged after 4 hours of free waiting time [in case of no overnight waiting].
• Night halt charges will be charged @ INR 50,000/- per night, for Domestic flights within India where for International flights USD 2000.
• On non-flying days if the aircraft is kept waiting by the client, 2 hours of flying time will be charged as 'Non Flying Day Charge'. For this day no night halt will be charged.
• Any Watch Hour extension levied by the airport will be billed separately after the flight has been completed, as this cannot be foreseen prior to the flight.
• Any additional charges levied by the Airport Authority, Customs or other regulatory authorities, which are not existent, now shall be billed separately.
• GST @ 18% shall be applicable as per the rule of Govt. of India.

13. In case of Foreign Nationals traveling to Defence Airfield we require the complete passport details, confirmed departure & arrival timings (no changes will be accepted by the Air / Naval Headquarters) at least 10 Working Days prior to departure of the flight.

14. Whilst the invoice will be issued by Target Air, the contract of carriage and all liabilities associated thereof will be between the Operator(Target Air) and the Customer (making payment to us). Based on industry norms:
• Upon confirmation of the charter by operator full payment will need to be remitted either through the online payment gateway details or remittance details provided in this proforma invoice above.
• In the interest of safety for technical reasons or in the event of bad weather it is the Operator’s discretion to cancel a charter without any notice and before commencement of the charter including after having received full payment upon which Target Air Services will endeavour given its industry wide network to seek a replacement aircraft. Failure to do so will limit the Operator’s or Target Air liability only up to a 100% refund of payment made by the Customer. However if the aircraft has been positioned in any other station other than base station and the cancellation is due to bad weather, then ferry charges for bringing aircraft back to base will need to be borne by the client.

15. Target Air Services will not be responsible for passengers carrying any contraband items & or involved/indulging in any illegal activities.

16. In the event of unforeseen circumstances, the company reserves the right to make changes in the ‘product offering’.

17. Declaration: While we endeavour to provide the aircraft as per customers’ requirement, Target Air Services shall not be liable to pay any financial damages or be held responsible for any cancellation of flights due to technical snags, inclement weather, poor visibility, non-availability of clearances or any other reasons beyond the control of the company. Also, please note the above offer is made subject to continuing availability of aircraft at the time of blocking the charter.

The client hereby agrees to the terms and conditions of the charter as defined above.
